These Terms and Conditions govern your use of the website at sanfranciscoasphaltpaving.com and your engagement with Advanced San Francisco Asphalt Paving ("we," "our," or "us") for asphalt paving, repair, and related services. By accessing our website or requesting services, you agree to these terms. If you do not agree, please do not use our website or engage our services.
By using this website or contacting us to request services, you confirm that you are at least 18 years old and have the legal authority to enter into a service agreement. If you are acting on behalf of a business or property owner, you represent that you are authorized to bind that party to these terms.
Advanced San Francisco Asphalt Paving provides asphalt paving, sealcoating, repair, resurfacing, parking lot services, driveway paving, and related site work in San Francisco, California, and surrounding service areas. Services are performed on residential, commercial, and mixed-use properties as agreed upon in a written estimate or service contract.
The information on our website describes our services in general terms. Actual scope, materials, and pricing are determined by a site assessment and confirmed in writing before any work begins. Nothing on this website constitutes a binding offer or guarantee of availability, price, or timeline.
Written estimates provided by Advanced San Francisco Asphalt Paving are valid for 30 days from the date of issuance unless otherwise stated. Estimates are based on the site conditions observed at the time of assessment. Changes to project scope, discovery of unforeseen conditions (such as unstable base material, underground utilities, or drainage issues), or significant changes in material costs may result in a revised estimate before work proceeds.
No work will begin without a signed agreement and any required deposit. Verbal estimates or informal communications are not binding and do not constitute a contract for services.
Scheduled work dates are confirmed in writing. We reserve the right to reschedule due to weather conditions, equipment availability, or circumstances beyond our control. We will provide reasonable advance notice when rescheduling is necessary.
If you need to cancel or reschedule a confirmed appointment, please notify us as soon as possible. Any cancellation or rescheduling fees are specified in your written service agreement. Failure to provide reasonable notice may result in a cancellation charge to cover scheduling and mobilization costs.
Asphalt paving work requires dry conditions and temperatures appropriate for proper curing. We may delay or reschedule work if weather conditions would compromise the quality of the finished surface.
Payment terms are stated in your written service agreement. In general, a deposit may be required before work begins, with the balance due upon completion. Accepted payment methods are specified in your agreement.
Invoices not paid within the terms specified in your agreement may be subject to late fees as permitted under California law. We reserve the right to pursue collection of unpaid balances through appropriate legal channels, including filing a mechanics lien on the property in accordance with California lien law.
Work may be suspended if payment obligations are not met on schedule. Any costs incurred due to a work stoppage caused by non-payment are the responsibility of the customer.
You are responsible for ensuring that the work area is accessible and clear of vehicles, personal property, and obstructions before the scheduled work date. We are not responsible for delays or additional costs caused by an inaccessible or unprepared work area.
If permits are required for the work, responsibility for obtaining and paying for those permits is addressed in your service agreement. Customers are responsible for ensuring they have the legal right to authorize work on the property, including any required approvals from homeowners associations, co-owners, or other parties with an interest in the property.
Any workmanship warranty provided by Advanced San Francisco Asphalt Paving is stated in your written service agreement. In the absence of a written warranty, no warranty is implied. Warranties, where provided, cover defects in workmanship under normal use conditions and do not cover:
TO THE EXTENT PERMITTED BY LAW, ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED.
To the fullest extent permitted under California law, Advanced San Francisco Asphalt Paving shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the performance of services or use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to services rendered shall not exceed the amount paid for the specific services giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.
We are committed to resolving disputes fairly. If you have a concern about our work or this agreement, please contact us directly first. We will make a good-faith effort to resolve the issue promptly.
If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing arbitration or litigation. Any unresolved dispute shall be resolved by binding arbitration in San Francisco, California, in accordance with the rules of a recognized arbitration provider. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in San Francisco, California.
